1. Introduction

Heroic Services, LLC, doing business as Heroic Gamez (“Heroic Gamez,” “we,” “us,” or “our”), provides game server hosting and related services (“Services”). By purchasing, accessing, or using our Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree, you must discontinue using our Services immediately.

“You” or “Customer” refers to the individual or entity using our Services.

2. Eligibility

You must be at least 16 years old, or the minimum legal age in your jurisdiction, to purchase our Services. If you are under the age of majority in your country, you must have permission from a parent or legal guardian.

3. Services Provided

  • Game server hosting for supported titles.
  • Web panels, tools, and management interfaces.
  • Additional server add-ons or premium features.

We reserve the right to modify, expand, suspend, or discontinue any Service at any time.

4. Account Responsibilities

  • Provide accurate registration information.
  • Maintain the confidentiality of your account credentials.
  • Accept responsibility for all activity under your account.

Heroic Gamez is not liable for unauthorized account access caused by your actions or negligence.

5. Acceptable Use Policy (AUP)


    A. Prohibited Activities
  • Host or distribute illegal content.
  • Use servers for harassment, threats, hate speech, or harmful activities.
  • DDoS, exploit, or attack our network or any third party.
  • Attempt to bypass server limits, restrictions, or system protections.
  • Host pirated game copies or copyrighted content without permission.
  • Use servers for crypto-mining, automation, or non-gaming purposes unless explicitly allowed.

B. Resource Abuse
Customers may not intentionally overload network capacity, CPU, RAM, or storage resources in ways that disrupt service performance.

Violation of the AUP may result in suspension or termination without refund.

6. Payments & Billing

    A. Subscription & Renewals
    Services operate on a recurring subscription unless otherwise stated. By purchasing a service, you authorize Heroic Services, LLC DBA Heroic Gamez to automatically renew and charge the payment method on file at the then-current rate unless cancelled prior to renewal.


    B. Late or Failed Payments
    If your payment fails:
  • Your service may be suspended after 72 hours.
  • Data may be deleted after 14 days of non-payment.

    • Requests for payment due-date extensions must be submitted by opening a support ticket prior to the suspension of service. Extensions are not guaranteed and are granted at the sole discretion of Heroic Gamez.


    C. Refund Policy
    Unless otherwise stated, first-time servers are eligible for a 14 day refund period. Refunds after 14 days are discretionary and may be considered for:
  • Billing errors.
  • Duplicate charges.
  • Technical failures directly caused by us.

    • D. EU Digital Services & Cooling-Off Rights
    If you are a consumer located in the European Union, you acknowledge that game server hosting is a digital service. By purchasing and activating a server, you expressly consent to immediate performance of the service and acknowledge that your statutory 14 day right of withdrawal may be waived once the service has begun.

7. Service Level & Availability

We strive to maintain reliable uptime and performance, but we do not guarantee:

  • 24/7 uninterrupted availability.
  • Loss-free data storage.
  • Perfect network performance.

To the fullest extent permitted by law, Heroic Gamez is not responsible for downtime, interruptions, data loss, or corruption.

8. Data & Backups

To the fullest extent permitted by law, Heroic Gamez does not guarantee the safety, availability, or restoration of any data, including worlds, backups, configurations, plugins, or mods.

Where server-side backups are enabled, Heroic Gamez will make reasonable efforts to restore available backups upon request. Server-side backups, where available, are retained for up to 14 days. Backup availability, integrity, and successful restoration are not guaranteed.

Backup restoration requests must be submitted by opening a support ticket. You remain responsible for creating and maintaining your own external backups at all times.

9. Modifications

We may update software, system configurations, control panel tools, or these Terms at any time. Continued use of the Services after any update means you accept the changes.

10. Suspension & Termination

We may suspend or terminate your service, with or without notice, if:

  • You violate the Terms or AUP.
  • You fail to pay on time.
  • Your activity poses risk to our systems or network.
  • You misuse or abuse the service.

If terminated for a Terms violation, no refunds will be issued.

11. Limitation of Liability

To the fullest extent permitted by law, Heroic Gamez is not liable for loss of profits, revenue, or data; server downtime or interruptions; mod incompatibility or game developer changes; third-party service failures; or user-caused misconfigurations or damage.

Maximum liability for any claim shall not exceed the total amount you paid to Heroic Gamez in the previous 30 days.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or violations of applicable law where such limitation is prohibited.

12. Indemnification

You agree to protect and hold Heroic Gamez harmless from any claims, damages, losses, or legal fees arising from your use of the Services, your violation of the Terms, or content hosted on your server.

13. Chargebacks & Disputes

Before filing disputes with a bank or payment provider, you agree to contact support to attempt to resolve the issue. Chargebacks initiated without communication may result in immediate account termination.

14. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.
